These Terms & Conditions govern all bookings made with Hadrian's Walking Holidays ("we", "us", "our"). By making a booking with us, you confirm that you have read, understood and agree to be legally bound by these Terms. If you do not agree to these Terms, you must not proceed with a booking.
1. Formation of Contract
A binding agreement between you and Hadrian's Walking Holidays is formed only when we have received your completed booking request, received the required deposit payment, and issued written confirmation of your reservation. Until written confirmation has been issued, no contract exists.
The individual making the booking (the "Lead Booker") confirms that they are at least 18 years of age and have the authority to enter into this contract on behalf of all persons named in the booking. The Lead Booker accepts full financial responsibility for all payments due in respect of the trip and confirms that all participants have agreed to these Terms.
These Terms apply equally to all members of the travelling party and it is the responsibility of the Lead Booker to ensure that each participant is aware of and agrees to them.
2. Payment Terms
A non-refundable deposit of £100 per person is required at the time of booking. This deposit secures your place on the selected trip and contributes toward administrative costs and supplier commitments made on your behalf.
The remaining balance of the total trip cost must be paid in full no later than 8 weeks (56 days) prior to the scheduled start date. Where a booking is made within 8 weeks of departure, full payment is required at the time of booking.
If the outstanding balance is not received by the due date, we reserve the right to treat the booking as cancelled by you. In such circumstances, cancellation charges as set out in Section 4 will apply and we may release your reserved services for resale.
All payments must be made in GBP unless otherwise agreed in writing.
3. Pricing and Scope of Services
The price of your trip includes only those services expressly detailed in your booking confirmation. No additional services, transport, meals or arrangements are included unless specifically confirmed in writing.
Unless otherwise stated, the price does not include travel to or from the starting point of the walk, personal expenses, travel insurance, equipment, or any ancillary services not expressly confirmed at the time of booking.
We reserve the right to correct obvious pricing errors and to amend pricing prior to confirmation of booking. Once full payment has been received, prices will not be increased except where changes arise from factors outside our reasonable control, including but not limited to taxation or statutory charges.
4. Cancellation by You
If you need to cancel your trip, you must notify us in writing. Cancellation will take effect on the date we receive written notice.
If you cancel more than 8 weeks before the trip start date, the £100 per person deposit will be retained and no further sums will be due.
If you cancel within 8 weeks of the trip start date, or after the balance due date has passed, 100% of the total trip cost will be payable and no refund will be made. This applies regardless of the reason for cancellation, including illness, injury, change of personal circumstances, travel disruption or any other event.
Once the balance has become due, all monies paid are non-refundable.
No refund will be given for failure to commence the trip, for arriving late, for leaving early, or for unused services during the trip.
For this reason, appropriate travel insurance is mandatory and must be arranged at the time of booking.
5. Cancellation or Amendment by Us
We reserve the right to cancel or amend a trip in circumstances including, but not limited to, operational necessity, safety concerns, supplier failure, severe weather conditions, insufficient participant numbers, or events beyond our reasonable control.
If we cancel a confirmed trip prior to departure and the cancellation is not due to your breach of these Terms, you will be offered either a full refund of all monies paid to us or the option to transfer to an alternative trip of comparable value, subject to availability.
We shall not be responsible for any consequential losses incurred by you, including transport arrangements, accommodation booked independently, insurance premiums or other costs not paid directly to us.
6. Mandatory Travel Insurance
It is a strict condition of booking that each participant obtains comprehensive travel insurance immediately upon booking.
Your policy must include adequate cover for trip cancellation, curtailment, medical expenses, emergency repatriation, personal accident, personal liability and loss or damage to luggage and personal belongings.
Failure to obtain suitable insurance does not alter or waive our cancellation policy, and no refund will be provided in circumstances where insurance cover would otherwise have applied.
We reserve the right to request proof of insurance prior to the commencement of your trip.
7. Luggage Transfer Service
Where luggage transfer has been arranged as part of your trip or booked as a standalone service, the following conditions apply.
Luggage must be clearly labelled and available for collection by 9:00am on each transfer day. We aim to deliver luggage to the next accommodation by approximately 5:00pm, although delivery times cannot be guaranteed and may vary due to traffic, weather conditions or operational factors beyond our control.
Each individual bag must not exceed 20 kilograms in weight. Bags exceeding this limit may be refused for safety reasons. Bags must be securely closed and must not have items attached externally. Loose or attached items such as walking poles, footwear, carrier bags or other equipment may be removed and treated as separate items.
We are not insured to carry valuables or fragile items. You must not pack money, jewellery, electronics, important documents or breakable items in transferred luggage. Such items must remain with you at all times.
While we handle luggage with reasonable care, we cannot accept responsibility for minor cosmetic damage to bags, wear and tear, damage to handles, wheels, straps, stitching or zips, or for loss or damage to contents. Clients are advised to use durable, weather-resistant luggage.
Standalone luggage transfers cancelled before the first scheduled movement will be refunded in full. Once luggage has been collected for the first transfer, no refund will be provided for unused days.
8. Health, Fitness and Personal Responsibility
Our trips involve walking significant distances over varied terrain which may include uneven surfaces, gradients and rural environments. By booking, you confirm that you are physically capable of completing the itinerary and that you have assessed your own suitability.
If you have any medical condition or injury that may affect your ability to participate safely, you must seek medical advice prior to booking.
You participate entirely at your own risk and accept full responsibility for your safety and wellbeing during the trip.
9. Behaviour and Conduct
We expect all participants to behave responsibly and respectfully towards fellow walkers, accommodation providers and members of the public.
If, in our reasonable opinion, your behaviour causes danger, distress, disruption or damage, we reserve the right to terminate your participation without refund. You will be liable for any loss or damage caused by your actions.
10. Force Majeure
We shall not be liable for any failure to perform or delay in performance of our obligations where such failure results from circumstances beyond our reasonable control. These may include, but are not limited to, severe weather, flooding, fire, industrial disputes, government restrictions, pandemics or other extraordinary events.
11. Limitation of Liability
Our liability for loss, damage or injury shall be limited to the total amount paid by you for the trip, except in cases involving death or personal injury caused by our negligence.
We shall not be liable for indirect or consequential losses, loss of enjoyment, loss of opportunity or any financial loss not directly attributable to our proven negligence.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
